But the focus on Thursday will be back at the Supreme Court, where the justices will hear oral argument in several birthright citizenship cases. (More on that below.) The court also has indicated it may release opinions today.

MORNING MUSING

All eyes (or ears) will be on the Supreme Court Thursday morning as the court hears oral argument in three consolidated cases challenging President Trump's executive order regarding birthright citizenship. I wanted to take a moment here to set expectations on today's argument.

Although we've noted this previously, it bears repeating: The issue before the court today is NOT the merits of birthright citizenship and whether it's guaranteed by the 14th Amendment or the merits of Trump's executive order. It also is not the propriety of district courts issuing nationwide injunctions in general, for instance, under the Administrative Procedure Act (APA). And, of course, the court won't issue a decision today — it's simply hearing argument in the cases. So those expecting a quick answer on either of those two issues I mentioned will be disappointed.

What the court is looking at today is simply this "modest request" proposed by the administration: namely, that the court restrict the scope of the preliminary injunctions issued by the three district courts (in Maryland, Massachusetts, and Washington) to parties actually before the court. Or, put another way, to strike down the use of nationwide injunctions in this context.

I'll be listening at 10:00 a.m. Eastern — and you can, too.
